Dagny Knutson Wins Appeal In Suit Vs Former Attorney

A California appeals court has ruled in favor of former professional swimmer Dagny Knutsonreinstating the $617,800 in damages she was awarded in 2016 before a judge threw out that verdict and ordered a new trial.

Knutson was a standout teenage swimmer who turned professional straight out of high school. She moved to California to join USA Swimming’s budding ‘Center of Excellence’ within Fullerton Area Swim Team, or FAST. Knuton, along with fellow pro Kate Zieglerwere told at the time by then-USA Swimming National Team Director Mark Schubert that USA Swimming would cover their tuition plus room & board to a local college along with their training expenses. But Schubert was let go by USA Swimming, and in the changeover at his position, USA Swimming told Knutson and Zeigler that only some of those expenses would be covered.

Knutson and Ziegler connected with attorney Richard Fosterwho reached out to USA Swimming on their behalf to procure a better deal. But Knutson has said Foster failed to disclose to her that he had previous relationships with USA Swimming brass, enough to constitute a conflict of interest. Foster was the former president of USA Water Polo, had represented Schubert legally and was a longtime friend of USA Swimming President Chuck Wielgus.  Foster admitted as much in an e-mail obtained by The OC Register.

Foster did come to a deal with USA Swimming on behalf of the two swimmers, but Knutson says that deal was far worse than what the two were originally promised. The new model was tied heavily to the swimmers’ world rankings – and as Knutson struggled with depression and an eating disorder over the next few years, the returns diminished and the deal was eventually terminated.

Knutson sued Foster for failing to disclose his conflict of interest, and in June of 2016, a jury ruled in her favor, holding that Foster had committed a breach of fiduciary duty and awarding Knutson more than $600,000 in damages. But by early 2017, a judge threw out that verdict, saying the original trial had “erred by applying an incorrect legal standard for causation in granting a new trial,” per The OC Register. In other words, the judge found that Knutson and her attorneys had failed to prove that someone other than Foster could have negotiated a better deal on her behalf, and sent the case back to trial with that extra burden of proof for Knuton to meet.

But this week, the Court of Appeal for the Fourth Appellate District of California reversed that ruling, reinstating the original verdict and the $600,000+ in damages. A three-judge panel agreed that “the motion for a new trial was granted on erroneous legal theories.”

Foster declined to comment to The OC Register, but did indicate that he would be filing a petition for rehearing.

Knutson’s case is tied to another scandal facing USA Swimming at present. Her attorney, Bob Allardalso represents Knutson’s former FAST teammate and training partner Ariana Kukors Smith, who says she was groomed and sexually abused by her swim coach, Sean HutchisonHutchison was a coach of the professional group at FAST. Kukors has sued Hutchison, USA Swimming and Schubert, and Allard tied Knutson’s legal victory to his other related ongoing case in a statement:

“There is no doubt in my mind, and this well reasoned and comprehensive decision I believe confirms, that USA Swimming conspired with one of its trusted friends, attorney and aquatics lifer Richard Foster, to screw over one of its star athletes,” Allard’s statement says. “I wish I can say that this inhumane treatment of a beautiful young woman entrusted to its care was unique.  Sadly, virtually the same thing later happened to Ariana Kukors-Smith, who was cruelly manipulated by USA Swimming and Hall of Fame Mark Schubert in order to advance their own selfish interests.  Shockingly, not one of the many persons involved in either situation has been fired by USA Swimming.  The only way to ensure real change at USA Swimming is for Congress to gut the entire organization and clean house similar to what happened with USA Gymnastics.”

If you make a promise, you should keep it. That’s not just old school, it’s just right. That said, I sure miss the good old days when, if you loved to swim fast, you swam fast. And if you got to an age where you couldn’t afford to train you found a relative to take care of you or yo worked part time to afford your sport. Swimming was just as relatively fast when it didn’t have paid athletes. And I really think most people were happier.
It makes some sense to me to have an attorney who is intimately familiar with USA Swimming, and shouldn’t have been a surprise to Dagney that Foster had such ties. Did he… Read more »

Jeeze. If this were the state of the sport when I first became involved I wouldn’t have chosen competititve swimming. As soon as money is involved, the real definition of sport is corrupted and bastardized. I guarantee that for every athlete who would bow out of the sport for lack of sponsorship another equally fast would come up to take his and her place who would train and race for the love of the sport. The policy in Chariots of Fire was right — stick to amateur standards. Hope she can get paid every penny. It seems USA swimming has always been particularly aware of how young some of the female stars in particular have been when they hit the scene. Instead of protecting them, we are seeing multiple instances where in some way or another coaches and leadership failed.

This story leads me to think USA Swimming is a corrupt organization. USA Gymnastics was corrupt. I don’t want to believe Swimming is like Gymnastics. This article doesn’t lead me to think otherwise. I hope Dagny gets justice and the same for Mr. Foster and the rest of those involved, regardless.

Uh, ya think? Corruption and greed at the highest levels. USAS is trash just like FIFA, IOC, USOC, USAG, et al. They are all run by greedy white men with no regard for athletes. The stories of depressed, addicted, and otherwise cast-off former pros are adding up.
