Rick Curl Resigns as CUBU President; Separate Accounts of Funds Begun

The team formerly known as the Curl Burke Swim Club, now known just as “CUBU,” has made the following statement today in the wake of the ongoing saga over co-founder Rick Curl and allegations of sexual relations with a former swimmer in the 1980’s. Curl has resigned his post as the President of CUBU, after previously having just taken a “leave of absence“.

The team has also established a segregated account for all dues paid for the 2012-2013 season, in an attempt to ensure that those funds go to support the training of the athletes who paid them. Though not explicitly stated, this would seem to be a protection against future lawsuits that might be filed.

Dear Families:

We are writing to provide a further update on the actions CUBU is taking to put the interests of our swimmers first while we also ensure the continued growth and strength of our Club.

Following his leave of absence last week, Rick Curl has resigned his position, effective immediately, as President of Curl Burke Swim Club, recently renamed CUBU Swim Club. Tom Ugast, the Club’s Director of Operations, has been named our acting Chief Executive Officer. In addition, Club management has decided, in an abundance of caution, to establish a segregated account that will control all registration and dues paid for the 2012-13 season and manage disbursements to make certain that current and future funds are used only to pay for pools, coaches and related operating activities. Art Davis, a local attorney who is well known to the Club and the swimming community, and who is also a CPA and highly experienced in trust and escrow account matters, has been retained in a fiduciary capacity for these segregated funds. Tom and Art will work together to manage all business operations of the Club while coaches will continue to handle their training sites. Club management is also consulting with coaches, parents, swimmers and various experts to explore other oversight reforms that may be appropriate to increase participation, transparency and accountability in its leadership, and ensure that the Club is a national leader in its compliance with USA Swimming rules and its Code of Conduct, in particular, the Articles dealing with Athlete Protection Policies, and Reporting Requirements.

Rick Curl and Noah Rucker are not guilty, everyone is innocent until proven guilty with physical evidence in a court of law. Stop convicting these two and anyone based on written and verbal complaints by an accuser. No person should be accused publicly anyway nor convicted by the accuser or their attys or the media. Realize that this person admitted to lying to her parents, to the courts, to the media, and is probably seeking money, fame, and malicious ruin of their coach. She never mentions her own fault in not saying if this happened and not voluntarily leaving the team and geographic area. A separate account has been set up for the new season. All registration dues will be deposited into the account to be used for coaching costs, meet entry fees, lane rentals, etc. All current and new registered swimmers should have received an email in regards to this. It was stated in a letter from CUBU’s lawyer…

Is Rick still making money off this team? Will any of the registration fees, etc be paid to Rick or is CUBU now a new organization not owned by Curl. Parents want to know if we are supporting this creep still.

When I watched the video of finals the first night, I noticed the still announced the swimmers’ club as ‘Curl Burke’….I thought that name was out? I think a CUBU person won both 4im’s. They have a lot of talent in the club with Katie, these two, the 12 year old flyer, etc, etc.

From the rumors that are around , they are still looking at a more permanent name change.Something like, Capital Area Swim Team was the last I heard.

CUBU is not the new name. It’s a temporary name to get through the last few remaining meets of the summer. A new name and logo will be decided upon before the start of the short course season.

Call USA Swimming, Jamie Fabos Olsen 719-866-4578 and Susan Woesnner, Director of Safe Sport 719.866.3589. Let them know they need to take a tough stance and do some digging into the matter, just like what was done at Penn State – To date, more than 60 USA Swimming coaches have been banned for life for sexually molesting young swimmers -enough is enough!

USA Swimming scheduled the hearing (yesterday’s hearing 8/1) to be conducted via conference call – why so accommodating? – is Rick Curl enjoying the Olympics in London? Dear Mr. Young:

It is unfortunate that Mr. Curl has been allowed to dictate the process. Ms. Currin deserves the issuance of swift and immediate justice. It is interesting to note that when an athlete, a decorated Olympic champion nonetheless, smokes pot, his membership is quickly suspended without a hearing but when a coach is accused of sexual molestation he not only is entitled to a full hearing but is allowed to control when it is conducted by “waiving his right to an emergency hearing”.

Honestly, I don’t really like the tone of which Allard seems to portray himself – as if he’s some sort of stuck up, gallavanting white-knight attorney.

He might be trying to do the right thing, but for the wrong reasons. And it is my own opinion and reading of the letter, to be sure, but if I recall, Allard seems to have a bit of an ego complex about the entire case.

Also: If I’m going to send a letter criticizing a practice, I would want to make sure I have spell and grammar-checked my document. Take note, Mr. Allard. I wouldn’t want to read one of your briefs.
